Shoplifter awarded $12,000 in damages

(CBC) - An admitted shoplifter has been awarded $12,000 for injuries he suffered during an altercation with a security guard and a store manager at a Superstore in B.C.'s Lower Mainland nearly three years ago. Daniel Baines admitted in court that he was trying to steal more than $100 worth of razor blades from the Superstore in Delta in August 2004.

The two employees grabbed him by the arm as he tried to leave the store. Baines tried to pull away, and the three men began to struggle.

All three ended up stumbling down the stairs, and Baines got kicked and punched during the altercation that led to his arrest.

He lost a tooth, and said he can no longer chew properly or speak properly.

Baines sued the store, claiming the use of force against him was not justified.

The store's lawyer argued that Baines was the author of his own misfortune; that when he stole the razors he should have expected to get stopped, and that Baines shouldn't have resisted when the security guard grabbed him.

In the end, B.C. Supreme Court Justice William Ehrcke ruled Baines did not deserve to be kicked or punched, and assessed damages at $15,000.

But he also decided that Baines was partly at fault, assessing his responsibility for his injuries at 20 per cent, reducing the award by $3,000.

Maybe it is time for me to take up a new profession!

In having subdued a shoplifter or two in my time, the store was silly in not training their security staff in how to properly handle a shoplifter. You can use force but you can't just start wailing on a guy. My store had in off duty police officers who taught us how to properly use joint manipulation and the proper language one uses out loud to protect yourself from lawsuits..

Case in point, we had apprehended a druggie shoplifter and in order to restrain him I emplyed a behind the back wristlock that while the suspect was co-operating, posed no pian to him whatsoever. The moment he tried to struggle, that's when I applied a wee bit of pressure to his wrist which then shot pain up to his shoulder. To which I also said aloud, " Sir, if you do not co-operate you will wind up hurting yourself." At that point I could steer him wherever I wanted to take him because at the slightest hesitation he would cause the severe pain that felt like his arm was going to be torn off.

Just pour some water on the floor at a WalMart, take a dramatic fall on it and make sure people see you wipe out. Pretty sure you could get some cash out of that.

They were justified in every bit of force they used. He resisted arrest, and thus made it worse on himself. If he would have cooperated everything would have been fine.

He was the one that broke the law and the store has to pay money.

I hate what this world is coming to.
