The lawn weed/fertilization service I use has a policy whereby if you don't specifically cancel the service before they come out in the spring, they just come out in spring and apply fertilizer. You have to call them to cancel or they assume you're still on board.
I contend that I don't have to call to cancel. Shaw the cable company tried this "negative billing" a few years ago and got into hot water. They sent letters to customers saying that they will add extra channels to your package unless you specifically tell them othewise. Many people ignored the letter, got the channels and complained to the province (Alberta). Shaw had their hands slapped. The gov't said they couldn't do this.
I contend that negative billing is not legal. I asked the lady to fax me a contract that I signed that specifies that I must call to cancel unwanted service. She then faxes me a couple of pages (a bill and a page that outlines my service package). Nothing with my signature and nothing resembling a contract.
Although I was very clear that I wanted to see what I signed that obligates me, she doesn't listen. On the phone, three times I said, "I didn't order your service this year." She just repeats her same old same old all over again, ignoring what I said or not hearing me.
I very specifically asked to see the contract that I signed and she faxes me this crap that has nothing to do with my request, and nothing that has my signature.
Any advice? Anyone experience this? Opinions on the legitimatacy of my compliant. Give me your honest opinion. I can take it.
