Sad to hear though that his home and Salon are basically ruined and their insurance might not cover it. Wish them all the best though.

I would be inexplicably pissed if insurance didn't fully cover the losses. WHAT, EXACTLY, DOES 'INSURANCE' COVER, IF NOT A NATURAL DISASTER THAT DESTROYED EVERYTHING IN SIGHT!?! Even though I'm still quite young in years, I'm beginning to understand that 'Insurance' companies don't ensure anything but that you will be royally screwed if the need ever arises that you should require coverage. You hear these stories from the states where a person has health insurance and at some point they begin to suffer from a disease which requires expensive medical care, and when they ask their insurance company for assistance, the company says, "oh, sorry, it must have been a pre-existing condition, we won't cover it." and then the family must blow their lifetime savings in legal and medical bills and are left in debt for the rest of their life...

and then there's these auto insurance companies that charge me an arm, leg and kidney just so I can drive my 89 camry around.

i'm beginning to think i should start my own insurance company. i could make millions...

Auto insurance is worse. Thanks to the new no-fault laws that have crippled the injury lawyers. You get hurt, the most you could get piad is about for grand, save for paralysis, death, loss of limb, or something of the sort.

House Insurance in New Orleans is the worst. There is Damage insurance for natural disasters, and damage insurance for Floods. Most people in New Orleans only had insurance for natural disasters - but not flood damage, so they royally got screwed.

The $4,000 cap relates to things like ankle sprains and "phantom" injuries. You know the ones I talk about...the ones where people (before) would have won the perverse lottery for getting into a minor fender bender.

If you are actually hurt, you can still sue for pain and suffering. And you can STILL be awarded compensation for economic loss such as the payment of car repairs (duh, which we all know about) and loss of salary, cost of treatment, etc.

Its much, much worse than that. Wards one through 4 are sublect to the cap. Ward 1 is bumps and bruises such as you discuss. Its gets more seroius more quicly than that.

My father is a personal-injury lawyer, and trust me when I say this cuts off a person's chances of getting the correct return they deserve by about 90%. Pain and suffering much of the time is chump change. General damages are the ones getting sliced, and thats where the real compensation is.

Eg. Ligament damage is under ward 3. Blow out your knees? Need and MRI and reconstrutive surgery? You can pay for it, but you won't be compinsated.

Whats worse is that fees and costs for going to trail, medicals, etc. have not gone down. If the insurance company tell you that they'll give you $1500 and you know how samll that number is, the costs to pursure it are staggering, and if you lose out getting the better claim, (it needs to be 60% closer to your number than theirs in the final settlement), you swallow those costs along with your barristor.
